1. ACCEPTANCE OF THE TERMS

Welcome to Libravie Ltd. A website that provides an online platform to introduce sellers and service providers to buyers and service users. It is expected by all, Libravie Ltd, its users and account holders to act in the spirit of goodwill to all, to be fair, just and decent in all our dealings and to operate in good faith. It is in this spirit and requirements of the Law that we have constructed our Terms of Use and Policies. Please read all our terms and policies as they constitute a legally binding agreement between Libravie Ltd (collectively referred to as Libravie, Libravie Ltd, ‘platform’ ‘us, ‘we’, & ‘our’) and you, whether an individual or an enterprise, defining your lawful and expected conduct when accessing Libravie Ltd whether on our website or via our Application. These terms are effective from January 2025 affecting current & new users once approved. You accept these terms when accessing Libravie.com and when registering. These terms and policies are updated from time to time which will be published on Libravie.com.

2. LIABILITY

Libravie provides an online platform for sellers and service providers to advertise their products and services for the public to view. Libravie is not involved in any negotiations or sale process between sellers and buyers and service providers and users. The verification, the discussion and the purchase is solely between buyers and sellers. Libravie is not the seller and is not the one posting listings hence, Libravie does not guarantee any of the content in postings placed by account holders. Whilst we take measures to ensure acting in good faith by all who use Libravie.com, we expressly disclaim any liability in connection with materials and information posted by account holders and users.

Libravie does not accept liability of any description for the posting of any unlawful, threatening, abusive, defamatory, racist including caste and tribal differences , obscene or indecent information, or material of any kind which violates or infringes upon the rights of any other person and our Terms of Use, including without limitation any material enabling, facilitating and encouraging behaviour and ideals that constitute a criminal offence, give rise to civil liability or otherwise violate any applicable law. Any such materials will result in the removal of the material and may lead to being barred from the website and reported to the authorities.

Libravie is not liable for any loss suffered whether financial or otherwise such as goodwill or reputation, that arose out of your use or misuse of our website. This stands even where we were made aware of or could have foreseen any such damage occuring. Any jurisdiction under which this disclaimer of warranties or exclusion of damages is exempted and if we are found to be liable, our liability to you or any third party (whether in contract, tort, negligence, strict liability in tort, by statute or otherwise) is limited to the lesser of (a) the total fees you paid to us in the 6 months prior to the action giving rise to liability, and (b) 200,000BIF.

Whilst every reasonable effort is made to ensure a trouble-free website, we cannot guarantee an error-free operation, or a secure access to our services, or that defects will be corrected. We do not give any promises or warranties (whether expressed or implied) about the operation and availability of our sites, services, applications or tools.

Release

If you have a dispute with any users or account holders of Libravie, you release us (and our directors, employees and agents) from any and all claims, demands and damages (actual and consequential) of every kind and nature, known or unknown, arising out of or in any way connected with such disputes. Although we are not obligated to intervene, Libravie does have a resolution centre that helps with disputes.

3. TERMS OF USE

It is understood that Libravie provides an online platform enabling sellers of products and services to advertise, making available an online marketplace for buyers to have a wider and more selective choice and to directly contact and finalise any purchases with the registered sellers and service providers. Libravie is not a party in the sale of goods and services or negotiations. Libravie, therefore, is not responsible nor liable in any way for the content of the ads.

However, since Libravie takes good and fair conduct very seriously, ensuring a trustable and effective platform for all, our registration process, Terms of Use and Policies are there to ensure fraudulant and bad behaviour is minimised, removed and reported. 2. ACCOUNT REGISTRATION

  1. You must be over 16 years of age to create an account or, if you are under the age of 16, you must have received permission to create an account with Libravie from your parent or guardian who will have read and agreed to the terms, policies and rules to operate on Libravie.
  2. Any user wishing to post an item has to register and create an account with Libravie Ltd and provide the information on the registration form. Certain features may require registration even for non-sellers.
  3. Account can be created as an indiviual or company or representative of a company or business.
  4. Only one account can be created. Duplicate accounts are not allowed that may result in temporary or permanent block on your account or postings. Where the device by which you access Libravie is used by more than one person, then we may request in date proof of IDs of all users.
  5. The information provided by you must be accurate, true and complete that must be verifiable upon request.
  6. Any false or misleading information on your ID or location may lead to blocking or closure of your account.
  7. Your Account has to be updated where any change occurs that affects it, such as new contact details or change of location.
  8. You are responsible for the security on your account and are liable for activity performed on it using your access details. You must immediately notify Libravie of any unauthorised access and or use of your account or breach of security. We will not and cannot be held liable for any loss or damage incurred from your failure to comply.
  9. You agree to immediately change your password to access your Libravie account if you have a suspicion that your Account access details were disclosed or probably used by the third parties.
  10. We reserve the right at our discretion to refuse or delete your Account, or your access to our services, with or without notice to you, in the event that you breach our Terms and Policies.

USING LIBRAVIE

As a condition of using Libravie, you agree to abide by the following:

  1. The contact details of all registered with Libravie must be current and accessible for Libravie as well as Libravie users, with an expected prompt response. Regular failure to do so may result in a hold on your account or ads.
  2. Adding fake or invalid phone numbers is not allowed by any users of the website.
  3. Personals ads, like dating, are not permitted.
  4. Ads are to be posted in the nearest appropriate category.
  5. Each item, job or service can only be posted once. Duplicates and spam ads are not allowed.
  6. Each ad must only contain one item. Multiple items must be listed in individual ads, except for the exact same item offering choice of colours and size. Job ads with multiple openings for the same position are exempt from this condition.
  7. URLs must be only entered in the URL field.
  8. All registered users must enter their contact details only in the correct field whilst submitting their ads. Revealing these details in the ad description, photos or title is not allowed.
  9. Irrelevant keywords spamming within your ad to manipulate searches is not allowed.
  10. Offensive language, hate speech or extreme profanity are not allowed. Action may be taken against offenders.
  11. Auction type ads are not permitted.
  12. Once an item is sold and no longer available it should be deleted by the poster.
  13. All items and services must be based in Burundi.
  14. Ads stating that they will not accept cash are not permitted.
  15. Ads stating that the item is not able to be inspected or picked up in person are not allowed.
  16. Pre-order ads are not allowed. All items must be in the possession of the seller before they can be posted.
  17. Ads or comments advocating hate, defamation, violence, discrimination, racism including ethnicity, are not alowed.
  18. Information of solely promotional nature with no offers of specific goods or services is not allowed.
  19. Direct or indirect references to any other web sites, references, or information about websites competing with Libravie is not allowed.
  20. We retain the right to remove any listings, regardless of category, that contains inaccuracies, falsehoods or misleading information, or exploits vulnerable users.
  21. You will not attempt to interfere with the normal operation of our website in any way, by means of software, viruses, trojans, worms and any other malware.
  22. You will not aim to collect and harvest details of other users or to contact them by any means for any commercial purposes.
  23. You will not copy, modify, distribute any other User Content without consent of the respective user.
  24. You have a legal title to the items offered for sale in your announcement.
  25. You have any or all of the required license or are otherwise legally authorized by applicable law, to offer for sale, to advertise, and distribute goods and services described in your listing.

4. WHAT IS NOT ALLOWED ON LIBRAVIE Aside from what is illegal in Burundi the following are not allowed on Libravie.

    1. Adult films and DVDs
    2. Adult toys or other erotic products
    3. Alcohol
    4. Botox and Dermal Fillers, includes related equipment and services
    5. Dangerous & prohibited chemicals
    6. Digital goods, including currencies
    7. Fake, replica, or unauthorised trademark items
    8. Firearms, ammunition and equipment
    9. Guns, including air guns, BB guns, replica guns, and paintball guns
    10. Silencers
    11. Ammunition, including ammo for paintball
    12. Hunting equipment
    13. Fireworks
    14. Flipper Zero Multi-tool Devices
    15. Gambling and Fruit/slot machines
    16. Lottery tickets
    17. Massage services
    18. Offering sexual service. Genuine massage and well-being services are allowed
    19. Ads that include reference to age, gender, race, physical attributes are not allowed
    20. Mystery Boxes where all contents, or potential contents, of the box are not clearly disclosed in the description of the ad
    21. Personal information or mailing lists
    22. Bulk emails, Internet Protocol (IP), instant messenger (IM), or mailing lists that contain names, addresses, phone numbers, or other personal info
    23. Tools or software designed to send spam
    24. Property ads that offer accommodation at a discounted rate or free in exchange for sexual relations or services Protected species
    25. Protected species whether in part or whole, alive or dead are not allowed
    26. Ivory
    27. Psychics, palmistry, fortune tellers, soothsayers, metaphysical, dark magic and evil eye removals, products and services of any such kind are not permitted.
    28. Red diesel
    29. Security tag removal products
    30. Steroids
    31. Stolen good, this includes blocked phones or no-signal phones
    32. Tickets not intended for sale
    33. Unlocked hardware and software
    34. Unlocking software (software that unlocks any electronic item, like a phone)
    35. Mileage Correction tools and services for vehicles
    36. all GPS & Signal jammers
    37. all “clock blocking” devices
    38. Weapons and knives
    39. Crossbows and archery sets


    5. FEES

    1. All listings are to be paid for except for free events
    2. All fees cover duration of your option chosen
    3. Charges are per month or annual
    4. Charges are for single or multiple ads
    5. For single listings of up to 9, payment will be prompted after submitting your final ad
    6. For multiple packages payment is needed prior
    7. Payment to be made by digital or bank transfer on the stated number or account details respectively
    8. Once payment is cleared your ad will go live within 24 hours, This does not include those who have paid for a number of listings
    9. We reserve the right to change the fees and payment methods for any reason
    10. All fees are non-refundable including annual payments, due to the nature of online services. Unless otherwise explicitly provided by mandatory rules of the applicable law, the fees are non-refundable

    6. INTELLECTUAL PROPERTY

    Content posted that infinges on the rights of third parties are not allowed, in particular the rights relating to patents, utility model certificates, industrial designs, layout designs for integrated circuits, traditional knowledge, crafts objects and distinctive signs. This includes copyright, design and trademark infrigements. Counterfeits are not allowed.

    You faithfully agree that your use of our platform and any section thereof, will not infringe or violate the rights of any other party or breach any contract or legal duty to any other parties.

    Any contents posted by you is your intellectual property and Libravie does not claim ownership of it. This being the case, you agree that Libravie is able to retain copies of all information given in the registration, your ads and its content and to use these as reasonably necessary for or incidental to the operation of Libravie and as described in these Terms and the Privacy Policy. You grant Libravie the non-exclusive, worldwide, transferable, perpetual, irrevocable right to copy, modify, adapt, store, publish, distribute, publicly display and perform, communicate and make available to the public the user content in connection with our services, including to using for marketing, advertising, and other purposes.

    These terms and our other policies make up the total agreement between Libravie and you. This agreement shall be governed and construed in all respects by the laws of Burundi. Any claims or disputes that may arise in connection with these terms must be resolved as per the laws and by the courts of Burundi.

    Where a court rules against any of the terms, the remaining terms will continue to apply. If we don’t enforce any particular provisions or breach thereof in the terms of use, we are not waiving our right to do so later.

    All notices to us must be sent by registered mail to 17 Rue de Kirundo, Quartier Asiatique, Bujumbura, Burundi. We will send notices to you via the email address you provide, or by registered mail.

    Any dispute between you and Libravie or between you and a post owner, has to be notified by email to disputes@libravie.com. For the purpose of maintaining a safe site for all to use, we will investigate any reported misconduct or breach of the terms of use, although we are not liable for any loss or damage suffered. Include as much information as possible including dates, times and mode of communication.
